Prediction Market Checker: which prediction markets can you use in your state?
On 15 October 2026 we read the help, fee and legal pages of 10 US prediction markets and the official pages of the states, courts and regulators acting on them. Only 3 (Robinhood prediction markets, Crypto.com prediction trading and Underdog prediction markets) say which states they leave out. Kalshi and Polymarket US list no states on the pages we could read, but courts in Nevada and Washington have ordered Kalshi to limit what it offers there, and 11 more states on our list have sued Kalshi, sent it a cease-and-desist letter or won an appeal against it.

Courts in Nevada and Washington have ordered Kalshi to limit what it offers, and 11 more states have sued it, sent it a cease-and-desist letter or won an appeal against it, according to TradingLookup's Prediction Market Checker (October 2026).
State and court actions we read
Each one from the state's own website, a court docket or the CFTC, quoted. 19 actions in 14 states: Connecticut, Illinois, Maryland, Massachusetts, Michigan, Missouri, Nevada, New Jersey, New York, Ohio, Rhode Island, Tennessee, Washington and Wisconsin.
Connecticut
- Lawsuit Connecticut lawsuit against Kalshi seeking an injunction on sports contracts (date not shown in the page text we saved)
- Cease-and-desist Connecticut cease-and-desist orders to nine platforms, including Polymarket, Crypto.com, Robinhood, ProphetX and Novig
Illinois
- Cease-and-desist Illinois Gaming Board cease-and-desist letters: Kalshi, Crypto.com and Robinhood (1 Apr 2025), Polymarket (27 Jan 2026)
Maryland
- Cease-and-desist Maryland Lottery and Gaming Control Commission cease-and-desist letter to Kalshi on sports contracts (7 Apr 2025). The federal court in Maryland refused to block it (1 Aug 2025). We could not read the Fourth Circuit docket for Kalshi's appeal.
Massachusetts
- Regulator notice Massachusetts Gaming Commission letters to the sports betting firms it licenses: offering sports event contracts in Massachusetts is prohibited for them (13 Nov 2025). No prediction market is named.
Michigan
- Lawsuit Michigan Attorney General's case against Kalshi (Dana Nessel v. KalshiEX, LLC, No. 1:26-cv-731), listed in a federal court order in western Michigan. The Attorney General's own pages on the June and September 2026 orders refused our checker, so those orders are not counted here.
Missouri
- Cease-and-desist Missouri Attorney General cease-and-desist letters on sports contracts (date not shown in the page text we saved)
Nevada
- Court order Nevada state court injunction against Kalshi (3 Apr 2026); the regulator moved to hold Kalshi in contempt on 4 Jun 2026
- Court order Nevada state court injunction against Polymarket (29 May 2026)
- Court order Robinhood agreed to limit event contracts in Nevada pending appeal (25 Nov 2025)
- Court order Crypto.com agreed to limit event contracts in Nevada pending appeal (14 Oct 2025)
New Jersey
- Cease-and-desist New Jersey Division of Gaming Enforcement cease-and-desist letter to Kalshi on sports contracts (27 Mar 2025). A federal court then blocked New Jersey from enforcing it while the case runs, and the Third Circuit upheld that (6 Apr 2026).
New York
- Lawsuit New York lawsuit against Kalshi (31 Jul 2026)
- Lawsuit New York lawsuit against Polymarket US (24 Sep 2026)
Ohio
- Appeal ruling Sixth Circuit ruling for Tennessee (decided with a parallel Ohio case): the order that blocked Tennessee from enforcing its sports betting laws against Kalshi is lifted
- Appeal ruling Sixth Circuit opinion (25 Sep 2026): federal law does not override Ohio's gambling laws, so the Ohio court's refusal to block the Ohio Casino Control Commission and Attorney General from enforcing them against Kalshi stands
Rhode Island
- Lawsuit Rhode Island's suit against Kalshi and Polymarket US (QCX LLC) in state court (21 May 2026), since moved to federal court. Read in the CFTC's court filing, because the Attorney General's own page refused our checker.
Tennessee
- Appeal ruling Sixth Circuit ruling for Tennessee (decided with a parallel Ohio case): the order that blocked Tennessee from enforcing its sports betting laws against Kalshi is lifted
Washington
- Court order King County Superior Court order (13 Aug 2026): Kalshi must stop sports, elections, politics, entertainment, culture, tech and science, and mentions contracts in Washington and geofence the state
Wisconsin
- Lawsuit Wisconsin Department of Justice lawsuits in Dane County against Kalshi, Robinhood, Coinbase, Polymarket and Crypto.com over sports contracts (23 Apr 2026)
Official pages that refused our checker
These state pages blocked our script on 15 October 2026, so nothing from them is used above. They describe actions you may want to read yourself:
- Kentucky: Kentucky Attorney General: lawsuits against Kalshi and Polymarket (June 2026)
- Massachusetts: Massachusetts Attorney General: court order on Kalshi
- Michigan: Michigan Attorney General: orders against Kalshi (June and September 2026)
- Minnesota: Minnesota Attorney General: prediction markets
- New Jersey: New Jersey Division of Gaming Enforcement: director's orders
- Rhode Island: Rhode Island Attorney General: lawsuit against Kalshi and Polymarket
The federal picture
Kalshi, Polymarket US, Crypto.com's exchange and ProphetX are exchanges designated by the Commodity Futures Trading Commission (CFTC), and Novig says it is one too. PredictIt runs under a CFTC staff no-action letter instead. Many states argue that sports contracts are sports betting and need a state licence; the platforms say federal law covers them. Appeal courts have reached different results, and two cases are now waiting at the Supreme Court:
- Supreme Court petition New Jersey has asked the Supreme Court to review the Third Circuit decision of 6 Apr 2026 in its case with Kalshi; Kalshi's response is due 9 Nov 2026
- Supreme Court petition Robinhood has asked the Supreme Court to review the Ninth Circuit decision of 28 Aug 2026 in its case with Nevada; Nevada's response is due 13 Nov 2026
- CFTC proposal CFTC proposed rule (9 Oct 2026) to define event contracts, including sports, as swaps
- Appeal ruling Third Circuit (6 Apr 2026) upheld the order that blocks New Jersey from enforcing its sports betting laws against Kalshi while the case runs. New Jersey has asked the Supreme Court to review it.
- Federal court order A federal court in Arizona blocked the state from enforcing its laws against Kalshi (preliminary injunction, 5 May 2026), as the CFTC's court filing records.
- Federal lawsuit The US government and the CFTC have sued six states (Arizona, Connecticut, Illinois, Minnesota, New York, Wisconsin) to stop them enforcing state law against CFTC-regulated exchanges (filing dated 28 May 2026).

Polymarket (international): not for US or UK traders
Polymarket's original site is an offshore exchange that settles in USDC. Its own pages say trading is blocked in the US and that UK users can only close positions. We name its pages as text, not links. US traders use Polymarket US, a separate, CFTC-regulated exchange. Both, with their quotes: Polymarket page.
Method
- Which platforms. 10 prediction markets open to US residents: exchanges designated by the CFTC and the brokers that sell their contracts (our judgement of the best known, not a market-share list). DraftKings Predictions is listed, but its pages refused our checker, so we list no facts for it; PredictIt's help pages loaded no text, so its entry rests on the CFTC's letter.
- What we read. Each platform's own help, fee, terms and legal pages; CFTC records; state attorney general, gaming regulator and governor pages; the Supreme Court docket (69 pages; 59 read). Nothing from review sites, news or comparison sites.
- How. Our script opens each page with a user-agent that names TradingLookup, after checking robots.txt, and saves the visible text with a SHA-256 fingerprint. A blocked page is recorded and not retried (kalshi.com itself blocked us, so Kalshi's full fee schedule and Member Agreement aren't here; its help centre was readable).
- Every claim has a quote. A claim is published only if its exact words are in the text we saved that day (81 of 81 claims).
- How cells are filled. The platform's statement and the state's actions are kept apart. "No" means the platform excludes the state or a court has ordered limits; a lawsuit, cease-and-desist letter or appeal ruling shows as "limits" because the platform may still operate while the case runs. We never read a lawsuit as a finding that a platform broke the law: these are the state's claims, and the platforms dispute them.
- Not covered: which individual markets (for example sports) work in your state today, beyond what a platform or a court order says. Check the platform's app before you trade.
